1. GENERAL

a) This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

b) This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.showmyProperty.in

Welcome to *[www.showmyproperty.in](http://www.showmyproperty.in)* (“Website”, “Platform”, “we”, “our”, “us”).

These Terms & Conditions (“Terms”) govern your access to and use of the Platform. By accessing, registering, or using this Website, you confirm that you have read, understood, and agreed to be legally bound by these Terms, the Privacy Policy, and the Disclaimer. If you do not agree, please do not use the Platform.

1. Nature of Platform & Service Provided

1.1 ShowMyProperty.in provides a *technology-based online listing service* that allows property owners, builders, developers, real estate agents, and brokers (“Sellers”) to upload and display property-related information for public viewing.

1.2 The Platform’s service is *strictly limited to hosting, displaying, and publishing property information submitted by third parties*.

1.3 The Platform *does not provide*:

* Property brokerage or agency services
* Property advisory, valuation, or consultancy services
* Negotiation or deal-facilitation services
* Legal, financial, or investment advice

1.4 The Platform acts solely as an *online intermediary* under:

* The Information Technology Act, 2000
* The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

1.5 The Platform is *not a party* to any agreement, transaction, or arrangement between buyers and sellers.


2. User Categories

* *Sellers:* Property owners, builders, developers, real estate agents, and brokers who submit listings
* *Buyers / Viewers:* Users who browse listings and contact sellers directly

 

3. Registration, Accuracy & Consent

3.1 Users must provide accurate, complete, and lawful information during registration and while using the Platform.

3.2 By registering or using the Platform, users *expressly consent* to the collection, use, and processing of personal data in accordance with the Privacy Policy and the *Digital Personal Data Protection Act, 2023*.

3.3 Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.

3.4 The Platform may suspend or terminate any account if false, misleading, or unlawful information is provided.

 

4. Listing Submission & Manual Review

4.1 All property listings submitted to the Platform are subject to *manual review*.

4.2 Manual review is limited *only to basic content checks*, such as:

* Completeness of information
* Formatting and clarity
* Compliance with Platform policies

4.3 Manual review *does not include verification* of:

* Ownership or title
* Legal status or approvals
* Pricing accuracy
* RERA registration or compliance

4.4 Approval or publication of a listing *does not imply verification, endorsement, recommendation, or guarantee* by the Platform.

4.5 The Platform reserves the right to reject, edit, remove, or disable any listing at any time without notice.

 

5. Prohibited Listings & Content

Users shall not upload or publish:

* Fake, misleading, or duplicate property listings
* Properties with disputed, illegal, or unclear title
* Government land or encroached land
* Content violating any law, regulation, or court order
* Copyrighted images or videos without authorization
* Obscene, defamatory, deceptive, or fraudulent material

Violation may result in *immediate removal of listings and permanent account suspension*.


6. Property Information Disclaimer

6.1 All property details are provided by sellers and displayed on an *“as-provided” and “as-available” basis*.

6.2 The Platform does not guarantee the accuracy, completeness, legality, or reliability of any listing.

6.3 Users must conduct *independent legal, technical, financial, and regulatory due diligence* before making any decision.

 


7. Buyer Responsibilities

Buyers acknowledge and agree that:

* They rely solely on seller-provided information
* They must independently verify ownership, approvals, and legality
* They should consult legal and professional advisors before any transaction
* The Platform bears *no responsibility for losses, fraud, or disputes*

 


8. Seller / Agent Responsibilities

8.1 Sellers and agents confirm and warrant that:

* They have lawful authority to list the property
* All information provided is accurate and truthful
* They comply with applicable real estate laws and regulations

8.2 Agents must possess valid authorization from the property owner.

 

9. Intermediary Liability Protection

In accordance with *Section 79 of the Information Technology Act, 2000*, the Platform:

* Does not initiate or materially modify third-party content
* Is not liable for user-generated content
* Acts upon lawful takedown requests or court orders

 

 

10. Payments & Commercial Services (CLEAR & USER-FRIENDLY)

10.1 ShowMyProperty.in *does not collect, hold, process, or facilitate*:

* Property sale consideration
* Token amounts
* Booking advances
* Security deposits

10.2 All payments relating to property transactions occur *directly between buyers and sellers*, outside the Platform.

10.3 The Platform may charge fees *only for website-related services*, such as:

* Listing publication
* Featured placement
* Advertising or promotional visibility

10.4 Platform fees are *not linked to property prices, deal outcomes, or transaction success*.

11. Intellectual Property & Content License

11.1 Users retain ownership of content uploaded by them.

11.2 Users grant the Platform a *non-exclusive, royalty-free, perpetual, worldwide license* to host, display, reproduce, and promote such content solely for Platform operations and marketing.

 

12. Indemnity

Users agree to indemnify and hold harmless the Platform, its owners, directors, and employees against all claims, losses, damages, penalties, or expenses arising from:

* Uploaded content
* Misrepresentation or fraud
* Violation of laws or third-party rights


13. Limitation of Liability

The Platform shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data.


14. Consumer Protection Act Clarification (CORRECTED)

14.1 ShowMyProperty.in provides an *online technology and information service*.

14.2 The Platform is *not involved in the sale, purchase, transfer, or execution of property transactions*.

14.3 Any disputes regarding property condition, title, pricing, possession, or delivery are *solely between buyers and sellers*.

14.4 The Platform’s responsibility is limited to providing access to its website features in accordance with these Terms.

 

15. Force Majeure

The Platform shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, government actions, or technical failures.

 

16. Amendments & Severability

16.1 The Platform may modify these Terms at any time. Continued use constitutes acceptance.

16.2 If any provision is held invalid, the remaining provisions shall remain enforceable.

 

17. Governing Law & Jurisdiction

These Terms are governed by Indian law.
Courts at *Hyderabad, Telangana, India* shall have exclusive jurisdiction.

  Sellers provide the property details.
  Buyers must verify before buying.
  We are not part of the deal.
